Tools for the measurements of results in Customs

Currently, the measurement and evaluation of performances is a practice adopted in whatever kind of organization, Customs and other public bodies included. Such tools, commonly known as “performance measurement systems” (or "PMS"), allow the optimisation of the organization's management process, properly adressing its decision making procedures, through the intelligent use of the amount of information and data available or aquired during the execution of its activity. AEO: self-assessment questionnaire and explanatory notes updated to take into account the possibilities of mutual recognition

The TAXUD General Directorate (Taxation and Customs Union) of the EU Commission, has adopted a new version of the self-assessment questionnaire for the AEO certificate and its explanatory notes, to complement such documents with additional information concerning the cases of mutual recognition of the certificates issued by other Countries. Moreover, as of 24th May 2011, the implementation of the befefits arising from mutual recognition of AEOs between the EU and Japan will begin.

US Biodiesel: countervailing and anti-dumping duties extended also to Canada

On July 2009, Regulations (EC) No 598/2009 and 599/2009 were published in the Official Journal of the EU. Those acts have established, respectively, a definitive countervailing and a definitive anti-dumping duty on imports of biodiesel originating from the USA (see our articolo), and collecting definitively the provisional duties established with Regulations (EC) n. 193/2009 and 194/2009.

With the implementing Regulations (EU) No 443/2011 and No 444/2011 of the Council, of 5 May 2011, said countervailing and anti-dumping duties are now been extended from the import of biodiesel in pure form to those in blend containing a percentage (in weight) equal or inferior to 20% of biodiesel originating from U.S.A. The same duties apply also to the biodiesel consigned from Canada, whether declared as originating in this Country or not, with the only exclusion of the biodiesel produced by the companies listed to the article 1 of both the Regulations and with the possibility to ask to the EU Commission a specific exemption from duties by those companies that have not circumvented the countervailing and anti-dumping measures established by the Regulations of 2009.

New Explanatory Notes to the Combined Nomenclature adopted

With the Communication (2011/C 137/01), the EU Commission has issued a new version of the explanatory notes to the Combined Nomenclature (CN). The CN is based on the Harmonized System (HS) of description and coding of goods (regulated by an International Convention concluded in Brussels on 14 June 1983), a numeric Code of 6 digits which represents the main system of classification of goods at global level, administered by the World Customs Organization (WCO) and available in the section "Public Documents" of our web site.

Combined Nomenclature: new tariff subheading for aerosol devices

The Regulation (EU) n. 428/2011 of Commission of 27 April 2011 amends the EEC Regulation No 2658/87 of the Council, of 23 July 1987, concerning theon tariff and statistical nomenclature and the Common Customs Tariff. The amendments are referred in particular to certain aerosol dispenser described within the Column 1 of the Table annexed to the Regulation to be classified into the CN codes indicated in the column 2.
