Extinction of the customs debt, a clarification from the European Court of Justice

Under the article 233 of Reg. (EC) n. 2913/1992 (Community Customs Code , "CCC"), the customs debt shall be extinguished, among other things, when, with regard to the goods declared for a customs procedure entailing the obligation to pay duties, goods, after their irregular introduction in the EU customs territory, before their release, are either seized and simultaneously or subsequently confiscated.

The Court of Justice specifies that the extintion of the customs debt takes place only if the the seizure of goods unlawfully introduced into the customs territory of the Community has been executed before the goods have gone beyond the first customs office situated inside that territory. Accordingly, the seizure and confiscation of the goods after that time no longer results in an extinction of the customs debt.

Il caso di specie riguardava un traffico di contrabbando di sigarette dal Kossovo all’Austria.  La polizia del Land dell’Alta Austria, grazie ad intercettazioni telefoniche, intercettava la spedizione nelle vicinanze della città di Wels (Austria) a bordo di un pullman che doveva raggiungere la città di Eferding, suo luogo di destinazione finale. Le sigarette venivano sequestrate dalle autorità doganali austriache, e successivamente confiscate e distrutte sotto controllo ufficiale.

Con decisione 13 novembre 2002, l’Ufficio doganale austriaco chiedeva a chi aveva organizzato l'operazione, il pagamento di dazi all’importazione dovuti sulle sigarette in questione, per un totale di 961,46 euro, il quale si opponeva, proponendo ricorso all’Unabhängiger Finanzsenat, Außenstelle Graz (Consiglio tributario indipendente, Sezione di Graz), che sospendeva il procedimento, sottoponendolo al vaglio interpretativo della Corte di Giustizia delle CE in via pregiudiziale. Quest'ultima, con Sentenza della Terza Sezione del 2 aprile 2009 ha stabilito che poichè nel caso di specie il sequestro di merci irregolarmente introdotte nel territorio comunitario è avvenuto dopo che queste hanno superato il primo ufficio doganale situato all’interno di tale contesto territoriale (e precisamente durante il trasporto, prima di raggiungere il primo luogo di destinazione), non si è generato alcun effetto estintivo dell’obbligazione doganale, che deve essere pertanto corrisposta dal ricorrente.
