US Biodiesel: countervailing and anti-dumping duties extended also to Canada

On July 2009, Regulations (EC) No 598/2009 and 599/2009 were published in the Official Journal of the EU. Those acts have established, respectively, a definitive countervailing and a definitive anti-dumping duty on imports of biodiesel originating from the USA (see our articolo), and collecting definitively the provisional duties established with Regulations (EC) n. 193/2009 and 194/2009.

With the implementing Regulations (EU) No 443/2011 and No 444/2011 of the Council, of 5 May 2011, said countervailing and anti-dumping duties are now been extended from the import of biodiesel in pure form to those in blend containing a percentage (in weight) equal or inferior to 20% of biodiesel originating from U.S.A. The same duties apply also to the biodiesel consigned from Canada, whether declared as originating in this Country or not, with the only exclusion of the biodiesel produced by the companies listed to the article 1 of both the Regulations and with the possibility to ask to the EU Commission a specific exemption from duties by those companies that have not circumvented the countervailing and anti-dumping measures established by the Regulations of 2009.

L’applicazione di queste ultime esenzioni è subordinata alla presentazione alle autorità doganali degli Stati membri di una fattura commerciale valida, redatta conformemente alle prescrizioni di cui all'allegato riportato in calce ai Regolamenti n. 443/2011 e n. 444/2011.

Il motivo dell’estensione dei dazi in questione al Canada è dovuto al fatto che la Commissione ha accertato che le misure compensative ed antidumping sulle importazioni del prodotto in esame erano state oggetto di elusione da parte di alcune società americane, le quali avevano eseguito dei  trasbordi del prodotto in questione in Canada ed a Singapore prima di immetterlo nell’UE, oppure avevano eseguito miscelazioni dello stesso con altro biodiesel, in modo da contenere i quantitativi di biodiesel americano nel prodotto finito entro percentuali pari od inferiori al 20%.

L’applicabilità delle misure compensative ed antidumping in oggetto con riferimento a Singapore viene invece esclusa in ragione dell’esiguità dei quantitativi di biodiesel spediti dal Paese verso l’UE.
